NEW CUMBERLAND – A mechanic alleges his former Hancock County employer wrongfully terminated him while he was on disability leave for an injury.
Tim Keller filed a complaint on Nov. 14 in Hancock Circuit Court against Chaney's Auto Repair & Towing LLC, care of Michael W. Geibel Sr., alleging that the former employer violated the West Virginia code and the Human Rights Act.
According to the complaint, the plaintiff alleges that on Aug. 23, he was terminated from his employment while he was off work receiving temporary total disability benefits from an injury sustained at work. He alleges he has suffered and will continue to suffer lost wages and benefits, humiliation, embarrassment, indignity and emotional distress. The plaintiff holds Chaney's Auto Repair & Towing LLC responsible because the defendant allegedly subjected him to discrimination, retaliation and termination for being disabled and for receiving workers' compensation benefits.
The plaintiff requests a trial by jury. He is represented by Frank X. Duff and Sandra K. Law of Schrader Byrd & Company PLLC in Wheeling. The case has been assigned to Circuit Judge David J. Sims.
