Mountaineer Casino Racetrack and Resort patron alleges chair broke, caused injuries

NEW CUMBERLAND – A Pennsylvania couple alleges the wife was injured when a chair she was using at a slot machine collapsed at a Chester casino.

Bertha Gardom and Robert Gardom filed a complaint on Nov. 17 in Hancock Circuit Court against the defendants alleging that Mountaineer Park Inc., MTR Gaming Group Inc., John Doe Manufacturer and John Doe Distributor alleging negligence and other counts.

According to the complaint, the plaintiffs allege that on Nov. 17, 2014, plaintiff Bertha Gardom was lawfully on the premises of Mountaineer Park's establishment and was sitting on slot machine chair when suddenly the chair collapsed, thereby causing her to violently fall with great force. She alleges she sustained severe and permanent injuries and damages.

The plaintiffs hold Mountaineer Park Inc., MTR Gaming Group Inc., John Doe Manufacturer and John Doe Distributor responsible because defendant Mountaineer Park allegedly negligently allowed the dangerous condition to exist on its Mountaineer Casino Racetrack and Resort premises and failed to properly inspect and repair the defective chair and failed to warn plaintiff Bertha Gardom of the unsafe condition of the subject chair in the gambling area.

The plaintiffs request a trial by jury and seek judgment against each defendant, jointly and severally, for compensatory damages, interest, costs and all other relief that the court may find just. They are represented by Jacob M. Robinson and Adam M. Hanasky of Robinson Law Offices in Wheeling. The case has been assigned to Circuit Judge Ronald E. Wilson
