Customer alleges dealer sold unsafe pickup truck

CHARLESTON — A Kanawha County woman is suing a Charleston vehicle dealer, alleging the defendant is guilty of negligent misrepresentation.

Beatice Scarberry filed a lawsuit Nov. 17 in Kanawha Circuit Court against Mountain State Pre-owned Vehicles LLC, alleging the defendant disregarded her safety and any other occupants of a used vehicle.

According to the complaint, in October 2013, Scarberry purchased a used 2002 Ford pickup truck from Mountain State. On Nov. 19, 2014, the suit says, Scarberry's mechanic found that the vehicle's undercarriage was rusted and in poor condition. 

The suit says Scarberry suffered monetary damages, including loss of use of the vehicle, inconvenience, mental anguish and a decrease in credit score. The plaintiff alleges, prior to the sale, the defendant failed to properly inspect and/or disclose the bad condition of the Ford pickup.

Scarberry seeks trial by jury, all damages, attorney fees, court costs and all other proper relief. She is represented by attorney David M. Dawson of John R. Mitchell LC in Charleston.
