Vehicle owner blames tow truck operators for injuries

MORGANTOWN — A Monongalia County man is suing Morgantown tow truck operators, alleging assault and battery.

Daniel Sloan filed a lawsuit Nov. 23 in Monongalia Circuit Court against Victor Solomon, Vic's Garage Inc., doing business as Vic's Towing, and John Doe, alleging the defendants consciously disregarded his rights.

According to the complaint, on Oct. 11, Sloan's vehicle was illegally towed on High Street in Morgantown by the defendants who proceeded to take it to their tow yard and then demand money for the return of the plaintiff's vehicle. 

In an attempt to leave before the Morgantown police arrived, the suit says, the defendants struck Sloan's with the plaintiff's vehicle that was hooked to the defendants' tow truck. As a result, the lawsuit states, Diaz has suffered injuries and monetary damages. 

The plaintiff alleges the defendants refused to return his vehicle, wrongfully exercised dominion over his personal property and threatened to hit him with his own vehicle.

Sloan seeks trial by jury, compensatory and punitive damages, pre and post-judgment interest, attorney fees and court costs and all other proper relief. He is represented by attorney Ryan J. Umina of Cranston & Edwards PLLC in Morgantown.
