Pennsylvania worker blames coal, gas businesses for injuries

PHILIPPI — A Pennsylvania man is suing coal and gas businesses, alleging their negligence led to injuries for the plaintiff. 

Billikeith A. Holbert of Uniontown, Pennsylvania, filed a lawsuit Nov. 22 in Barbour Circuit Court against Patterson-Uti Management Services LLC, Consol Energy Inc., CNX Gas Company LLC and John Doe, alleging they failed to provide a reasonably safe place to work.

According to the complaint, on Nov. 27, 2014, Holbert was working at an oil and gas well in Philippi, when Patterson-Uti employee John Doe negligently operated a crane, causing a steel pipe to violently strike the plaintiff, slamming him to the ground.

The suit says Holbert suffered disabling injuries, including disc herniation, resulting in surgery, medical expenses, pain and anguish and loss of earnings. The plaintiff alleges Patterson-Uti's employee negligently took an unreasonable shortcut to expedite the work and failed to operate the crane in a proper and safe manner.

Holbert seeks trial by jury, judgment for all damages, attorney fees, court costs and expenses, pre- and post-judgment interest and all other additional relief. He is represented by attorneys Carl A. Frankovitch and Anthony S. DaDamo of Frankovitch, Anetakis, Colantonio & Simon in Weirton.
