CHARLESTON — A Kanawha County woman is suing Kentucky Fried Chicken, alleging the defendant's negligence led to injuries for the plaintiff.
Mona L. Vassel of Chesapeake filed a lawsuit Nov. 18 in Kanawha Circuit Court against B. W. Painter Inc. d/b/a Kentucky Fried Chicken, alleging the defendant breached its duty to exercise reasonable care to protect its customers.
According to the complaint, on Jan. 24, 2015, Vassel walked into the lobby at a Kentucky Fried Chicken restaurant in Charleston when she tripped on the furled floor mat and fell. As a result of the fall, the suit says,, Vassel sustained injuries to her shoulder and back, and suffered physical and mental pain, diminution of her ability to enjoy life and medical expenses.
The plaintiff alleges Kentucky Fried Chicken negligently created a hazardous and dangerous condition, failed to repair or replace the furled mat and failed to provide adequate warning signs.
Vassel seeks trial by jury, judgment in an amount to fully compensate her for injuries, pre- and post-judgment interest, costs and expenses for this action and all other proper relief. She is represented by attorney Shawn R. Romano of Romano & Associates PC in Charleston.
