Customer blames Bigley Foodland Fresh owner for injuries

CHARLESTON — A customer is suing a Kanawha County store operator, alleging the defendant's negligence led to injuries for the plaintiff. 

Kendra Williams filed a lawsuit Nov. 21 in Kanawha Circuit Court against Bigley Markets Ltd., doing business as Bigley Foodland Fresh, alleging failure to maintain its premises in a reasonably safe condition.

According to the complaint, on Aug. 5, 2015, while Williams was attempting to leave the Bigley Foodland Fresh in Kanawha County, one of the defendant's employees, who was entering the store, struck and knocked the plaintiff to the floor.

The suit says the collision caused Williams to be permanently injured, including two fractures to her right leg. The lawsuit states she has experienced great pain of body and mind, plus medical and travel expenses. The plaintiff alleges Bigley Foodland Fresh 's employee failed to keep proper lookout and negligently collided with her.

Williams seeks trial by jury, judgment in an amount to adequately compensate for injuries, plus damages with interest and costs of court. She is represented by attorney Larry O. Ford of Meyer, Ford & Glasser PLLC in Charleston.
