WHEELING – A Wheeling property owner is seeking more than $170,000 from two guarantors after the lease for a Long John Silver's restaurant was allegedly breached.
OVA LLC filed a complaint on Nov. 22 in Ohio Circuit Court against Syed F. Jafrey and Aesha A. Jafrey alleging breach of contract.
According to the complaint, the plaintiff entered into a lease agreement for a National Road property in 2008 to MSAA Partners to use as a Long John Silver's franchise. The suit states the defendants were listed as guarantors. The plaintiff alleges the terms and conditions of the lease were breached and that it is owed more than $170,000.
The plaintiff holds Syed F. Jafrey and Aesha A. Jafrey responsible because the defendants allegedly breached their duty to personally guaranty the lease agreement on behalf of MSAA.
The plaintiff requests a trial by jury and seeks judgment against the defendants in the amount of $174,203, pre- and post-judgment interest, costs, expenses, attorney's fees and all other reasonable relief. It is represented by Charles J. Kaiser Jr. and Jeffrey D. Kaiser of Phillips, Gardili, Kaiser & Altmeyer PLLC in Wheeling. The case has been assigned to Circuit Judge David J. Sims.
