PINEVILLE – A Wyoming County business and individuals are alleged to have not paid back a loan.
Merchant Capital Group LLC filed a complaint on Nov. 28 in Wyoming Circuit Court against Michael's Used Cars Inc., doing business as Mike's Auto, Michael D. Osborne and Barbara A. Osborne alleging breach of contract.
According to the complaint, the plaintiff alleges that as a result of defendants' breach, it has suffered damages in the amount $8,601.56. The plaintiff holds Michael's Used Cars Inc., Michael D. Osborne and Barbara A. Osborne responsible because the defendants allegedly failed to make payments under the terms of the agreement.
The plaintiff requests a trial by jury and seeks judgment against defendants, for damages amounting to $8,601.56, attorney's fees and costs expended for this action and all other relief it may be entitled. It is represented by Megan Urban of Lloyd & McDaniel PLC in Louisville, Kentucky. The case has been assigned to Circuit Judge Warren R. McGraw.
