Lumber business alleges defendants owe more than $21,000

PHILIPPI — A Pennsylvania lumber business is suing multiple defendants, alleging they owe more than $21,000. 

O.C. Cluss Lumber Company filed a lawsuit Nov. 30 in Barbour Circuit Court against Skinner Properties LLC, Thomas R. Ross, David Trust Company, Builders Group Inc., Valley Supply Co., and Central Supply Company of West Virginia, alleging failure to to perform contractual obligations and unjust enrichment.

According to the complaint, O.C. Cluss Lumber provided labor, services, materials, supplies and/or equipment to the property owned by Skinner. The suit says $21,388.39 remains unpaid, and the plaintiff is a beneficial owner of a mechanical lien against Skinner. 

The plaintiff alleges the defendants failed to make payments on the said amount that remains due. 

O.C. Cluss Lumber seeks trial by jury, judgment against defendant Skinner not less than $21,388.39, enforcement of the plaintiff's lien, pre- and post-judgment interest, court costs and attorney fees, plus all just and proper relief.
