Bilfinger Westcon Inc. accused of wrongfully terminating man after injury

NEW MARTINSVILLE – A Pennsylvania man alleges he was terminated by his Wetzel County employer after being injured on the job and filing a workers' compensation claim.

Joseph Allen filed a complaint on Nov. 30 in Wetzel Circuit Court against Bilfinger Westcon Inc. alleging that the former employer violated the West Virginia Human Rights Act.

According to the complaint, the plaintiff alleges that on Nov. 11, 2015, due to his medical condition and for filing workers' compensation claim, he was fired from his employment with the defendant. As a result, he alleges has suffered and continues to suffer loss wages, emotional distress, loss of dignity and aggravation. The plaintiff holds Bilfinger Westcon Inc. responsible because the defendant allegedly failed to provide reasonable accommodations and did not reinstate him after he was released by his physician to return to work without restrictions.

The plaintiff requests a trial by jury. He is represented by Frank H. Duff and Sandra K. Law of Schrader Byrd & Companion PLLC in Wheeling.
