Property casualty insurer alleges another insurance company violated contract

WHEELING — An Ohio property casualty insurer is suing another insurance company, alleging breach of contract and breach of duty.

The Cincinnati Insurance Company of Fairfield, Ohio, filed a lawsuit Dec. 1 in Ohio Circuit Court against Motorist Mutual Insurance Company, alleging the defendant breached its duty to indemnify an additional insured party.

According to the complaint, as a result of Motorist Mutual's denial of duty, Cincinnati Insurance was forced to provide defense to Norco Construction Company's litigation and was forced to indemnify the contractor for the settlement reached. 

The plaintiff alleges Motorist Mutual denied to tender defense to Norco and continued to refuse and recognize the additional insured under the policy.

Cincinnati Insurance seeks trial by jury, declaration the defendant owed an obligation to defend Norco Construction and to reimburse the plaintiffs expenses for the litigation and settlement paid on Norco's behalf and all other proper relief. It is represented by attorney Adam M. Burnes of Walsh, Barnes, Collis & Zumpella PC in Pittsburgh.
