Family alleges they were injured in accident on W.Va. 2

Car accident 04

WHEELING – A Hancock County family alleges they were injured when a Kansas man lost control of his truck and struck their vehicle.

Kenny J. Willey; Melinda R. Willey; Cooper A. Willey, a minor; and Ethan J. Willey, minor; filed a complaint on Nov. 18 in Ohio Circuit Court against Tom G. Taplin and GEICO Indemnity Co. alleging negligence.

According to the complaint, the plaintiffs allege that on Nov. 22, 2014, they were passengers in a motor vehicle owned and being driven by Cynthia Willey traveling northbound on state Route 2 when defendant Taplin negligently crashed into their vehicle. They allege they suffered and will continue to suffer bodily injuries that require medical treatment, pain, distress and discomfort. The plaintiffs holds Taplin and GEICO Indemnity Co. responsible because Taplin allegedly failed to properly maintain control of his vehicle, which was insured by GEICO.

The plaintiffs request a trial by jury and seek compensatory damages in excess of court's jurisdictional minimum amount, pre- and post-judgment interest, costs and expenses and all other just and fair relief. They are represented by Steven M. Recht of Recht Law Offices in Weirton. The case has been assigned to Circuit Judge James P. Mazzone.
