Woman alleges Divison of Corrections did not respond to FOIA request

CHARLESTON – A woman alleges her Freedom of Information request did not receive a response as required by law.

Debra Hutcheson filed a complaint in Kanawha Circuit Court against West Virginia Division of Corrections citing the West Virginia Freedom of Information Act.

According to the complaint, the plaintiff alleges that on Aug. 16, she submitted a request to defendant for its public records pursuant to the WVFOIA. The plaintiff holds West Virginia Division of Corrections responsible because the defendant allegedly failed to respond to plaintiff's request.

The plaintiff requests a trial by jury and seeks an order declaring that defendant's refusal to disclose information is unlawful and the production of all information improperly withheld, award for attorneys' fees, costs and all other just and proper relief. She is represented by Sean W. Cook of Meyer, Ford & Glasser PLLC in Charleston. The case has been assigned to Circuit Judge Jennifer F. Bailey.
