CHARLESTON — A beneficiary is suing Hinton nursing home operators, alleging their negligence and insufficient measures led to the injuries and death of a patient.
William Foster, on behalf of the estate and wrongful death beneficiaries of Emma Petrey, filed a lawsuit Nov. 28, in the Kanawha Circuit Court against AMFM LLC, Commercial Holdings Inc., Integrated Commercial Enterprises Inc., Manzanilla Holdings LLC, Summers Nursing and Rehabilitation Center, et al, alleging failure to properly operate and control a nursing home.
According to the complaint, from Oct. 28, 2011, until her death Sept. 22, 2014, Petrey, 77, was a resident at Summers Nursing & Rehabilitation Center. The suit says during that time she suffered personal injuries and damages to her health that led to her death.
The plaintiff alleges the defendants negligently created a dangerous environment, failed to properly discharge their obligations to their residents and failed to adopt and implement appropriate policies and procedures to protect their residents from abuse and neglect.
Foster seeks trial by jury, judgment for damages in in excess of the minimum jurisdictional amount of the court, costs of litigation and all other relief to which he is entitled. He is represented by attorneys at McHugh Fuller Law Group PLLC in Hattiesburg, Mississippi.
