Wheeling Hospital accuses pediatric doctor of breaching contract after resignation

Contract 10

WHEELING – A medical facility alleges a pediatric physician abandoned her patients with her sudden resignation.

Wheeling Hospital Inc. filed a complaint on Dec. 2 in Ohio Circuit Court against Lori L. Archbold M.D. alleging breach of contract and other counts.

According to the complaint, Archbold allegedly abruptly resigned her employment without notice or warning on Oct. 31 and abandoned her patients at defendant's facility, unlawfully kept and maintained patients' records and failed to repay her unearned salary advances. The plaintiff alleges that as a result of defendant's actions, it suffered and will continue to suffer damages, including but not limited to costs associated with her abandonment of patients, training costs for her replacement and loss of revenue.

The plaintiff requests a trial by jury and seeks judgment against defendant for all damages available under the law. It is represented by W. Scott Hardy and Daniel D. Fassio of Ogletree, Deakins, Nash, Smoak & Stewart PC in Pittsburgh. The case has been assigned to Circuit Judge David J. Sims.
