WINFIELD – A Putnam County woman alleges a medical device manufacturer sells a defective device.
Lora Crouser filed a complaint on Dec. 5 in Putnam Circuit Court against Smith & Nephew Inc. alleging negligence.
According to the complaint, the plaintiff alleges that she was implanted with defendant's uni tibial baseplate. As a result of the implantation of the defective device, she suffered physical injury, medical expenses for continued diagnostic and preventive treatment, mental and physical pain and disability. The plaintiff holds Smith & Nephew Inc. responsible because the defendant allegedly wrongfully designed, manufactured, marketed, distributed and sold the defective tibial baseplate and failed to provide adequate warnings on the dangers of using the device.
The plaintiff requests a trial by jury and seeks compensatory and punitive damages, costs and disbursements, attorney's fees, pre- and post-judgment interest and such other equitable relief.
