Consumer accuses debt collector of wrongful practices

FAYETTEVILLE — A West Virginia man is suing a finance business, alleging unfair and unconscionable collection practices.

Matthew A. Clark filed a lawsuit Dec. 7 in Fayette Circuit Court against Gateway One Lending & Finance LLC, invasion of privacy in violating the West Virginia Consumer Credit and Protection Act.

According to the complaint, on Oct. 13, Clark began receiving and continued to receive telephone calls from Gateway One, attempting to collect and alleged debt. As a result, the suit says, he was abused and oppressed and has suffered inconvenience, indignation and annoyance. 

Clark alleges the defendant allegedly to place calls even after it was informed that plaintiff does not want to receive any call regarding his alleged debt.

Clark seeks trial by jury, compensation for actual, punitive and statutory damages, costs of litigation and all other proper relief. He is represented by attorneys Ralph C. Young, Christopher B. Frost, Steven R. Broadwater Jr. and Jed R. Nolan of Hamilton Burgess, Young & Pollard PLLC in Fayetteville.
