BECKLEY — A Raleigh County woman is suing a licensed insurer, alleging it owes $25,000 in breach of an insurance contract.
Sarah N. Bolen filed a lawsuit Dec. 12 in Raleigh Circuit Court against Erie Insurance, alleging failure to comply with its contractual obligations.
According to the complaint, on Dec. 12, 2014, Bolen was injured in an accident caused by a driver who was insured by Erie Insurance. At the time of the incident, Bolen's vehicle was also insured by Erie, the suit says.
As a result of the accident, the lawsuit states, Bolen has experienced pain and suffering, mental anguish and medical expenses. The plaintiff alleges Erie Insurance has failed to honor its own under-insured motorist coverage.
Bolen seeks trial by jury, judgment for the full value of the under-insured motorist policy of $25,000 and other amounts that will fairly compensate the plaintiff's damages, costs of litigation and all other proper relief. She is represented by attorney Anthony J. Sparacino Jr. of Beckley.
