Kitchen designer accuses lumber business of discrimination

LOGAN — A Boone County woman is suing a Parkersburg lumber business, alleging age discrimination, disability discrimination and wrongful termination.

Deborah Miller filed a lawsuit Dec. 9 in Logan Circuit Court against Badger Lumber Company Inc. and Michael Ferrell, alleging violation of the West Virginia Code.

According to the complaint, on Oct. 7, Miller, who had worked for Badger Lumber since 2011, was terminated from her employment due to her age (63) and perceived disability from a knee injury suffered at work. As a result, the suit says, she has sustained pain and suffering, mental anguish, lost wages and benefits, and medical expenses. 

The plaintiff alleges Badger Lumber and Ferrell failed to provide reasonable accommodations for her medical condition and subjected her to unlawful discriminatory practices with respect to compensation, tenure and other terms and conditions of employment.

Miller seeks trial by jury, compensatory and punitive damages, attorney fees and costs of court, pre- and post-judgment interest and all other just relief. She is represented by attorneys Nathan D. Brown and Joshua S. Ferrell of Ferrell & Brown PLLC in Williamson.
