Pocahontas man blames family physician for father's death

MARLINTON — A Pocahontas County man is suing a family physician, alleging medical negligence in the death of the plaintiff's father.

Patrick A. Lambert, individually and as personal representative of the estate of William O. Lambert, deceased, filed a lawsuit Dec. 9 in Pocahontas Circuit Court against Dr. John W. Eilers, alleging failing his duty to provide reasonable care. 

According to the complaint, within hours after being released from Eilers' care Jan. 16, 2015, William Lambert suffered a myocardial infarction with pulmonary edema, which led to his untimely and wrongful death Feb. 4, 2015. 

The plaintiff alleges Eilers failed to provide certain medical services to William Lambert and failed to refer him to the nearest facility capable of diagnosing and treating him for possible cardiac event.

Patrick Lambert seeks trial by jury, compensatory and non-compensatory damages, attorney fees and court costs, pre- and post-judgment interest and all other equitable relief.
