Estate administrator accuses nursing home facility operators of abuse

CHARLESTON — An estate administrator is suing Fayette County nursing home facility operators, alleging mistreatment, maltreatment and abuse of a resident.

Rita G. McGuffin, as administrator of the estate of Wilma G. Withrow, deceased, filed a complaint Dec. 1 in Kanawha Circuit Court against 422 23rd Street Operations LLC, Genesis WV Holdings LLC, doing business as Hidden Valley Center, Brian Chapman and John Does, alleging failure to to discharge their obligations of care and the required supervision to ensure Withrow's safety.

According to the complaint, Withrow was a resident at Hidden Valley Center for more than eight years. While under the care of the defendants, the suit says, she suffered catastrophic injuries and damages, including facial lacerations, scarring, extreme pain and mental anguish and, ultimately, death,. 

The plaintiff alleges the defendants failed to provide a safe environment, failed to provide proper supervision, and failed to take appropriate corrective actions to prevent, eliminate and correct deficiencies and problems.

McGuffin seeks trial by jury, compensatory and punitive damages in an amount to be determined at trial, costs of suit and all other just relief. She is represented by attorney Travis A. Griffith of Griffith Law Center PLLC in Charleston.
