Customer blames shoe store, employee for assault

CHARLESTON — A Kanawha County woman is suing a Charleston shoe store and employee, alleging battery and negligence.

Lakeisha Simon filed a complaint Dec. 2 in Kanawha Circuit Court against Shoe Show Inc. and John Doe, alleging they violated the West Virginia civil battery laws.

According to the complaint, on Dec. 26, 2014, Simon was returning a Christmas gift to Shoe Show at Charleston Town Center Mall to get a different size. After she got a new pair and left the store, the suit says, she was violently attacked by John Doe, a Shoe Show employee, who accused her of shoplifting. 

The lawsuit states Simon suffered severe and permanent physical and mental injuries, medical expenses and loss of enjoyment of life. The plaintiff alleges John Doe failed to act in a reasonable and prudent manner and violently attacked her. 

Simon seeks trial by jury, compensatory and punitive damages, attorney fees, costs and expenses for this action and all other proper relief. She is represented by attorney Michael J. Del Giudice of Ciccarello, Del Giudice & Lafon in Charleston.
