POINT PLEASANT — Two Mason County parents are suing Point Pleasant medical care providers, alleging their negligence led to the wife's suffering during her pregnancy and the delivery of a baby boy with severe physical ailments.
Beth Daniel Kearns and Kevin William Klingensmith, individually and as guardian of Kevin William Klingensmith Jr., a minor, filed a lawsuit Dec. 7 in Mason Circuit Court against Dr. Fri Mofor-Eta, Moria Tannenbaum and Pleasant Valley Hospital, alleging lack of professional care
According to the complaint, Kevin W. Klingensmith was born prematurely with a variety of serious medical problems, including cerebral palsy. The suit says Kearns and Kevin W. Klingensmith Jr. suffered personal injuries and damages, past and future medical expenses, pain and suffering and loss of enjoyment of life and plaintiff Kevin William Klingensmith suffered loss of consortium of his son.
The plaintiffs allege the defendants failed to exercise reasonable and prudent care in treating Kearns during her pregnancy and failed to perform appropriate testing.
The plaintiffs seek trial by jury, judgment for all damages suffered, pre- and post-judgment interest, attorney fees and costs of court. They are represented by William L. Mundy of Mundy & Associates in Huntington.
