Widow accuses medical providers of negligence in husband's death

BECKLEY — A widow is suing Raleigh County medical providers, alleging insufficient measures were taken to prevent injuries and the death of her husband.

Mary Elizabeth Robinson, as administrator of the estate of Heath Wayne Robinson, filed a complaint Dec. 9 in Raleigh Circuit Court against Hope Clinic PLLC, PPPFD Inc. and Sanjay R. Metha MD, alleging they negligently departed from acceptable medical practice standards.

According to the complaint, as a result of the defendants negligence, Heath Wayne Robinson died Oct. 24, 2013, nine days after his first appointment with the Hope Clinic. 

Mary Elizabeth Robinson alleges loss of consortium and says the defendants negligently prescribed a massive dose of opioid to her husband without knowing that at that time, he has already lost his tolerance to massive dose of opioid.

Robinson seeks trial by jury, judgment for all damages in an amount within the jurisdictional limits of the court and court costs. She is represented by attorneys James D. McQueen Jr. of McQueen Davis PLLC in Huntington, and by Christopher J. Heavens of Heavens Law Firm PLLC in Charleston.
