Amber Schultz, a single mother of three school-age children, was employed to work full time at the Little General store in Omar from approximately June 18, 2013, until June 18, 2015, according to a complaint originally filed in Kanawha Circuit Court but later transferred to Logan Circuit Court.
Schultz claims on June 18, 2015, her employment was terminated and no specific reason was given for her termination.
The plaintiff was fired based in whole or in part because of her gender and for reporting Robert Strothers, a customer, for driving under the influence of alcohol, improperly brandishing a gun and other unlawful acts on the premises of Little General, according to the suit.
Schultz claims Elaine Kilgore, her supervisor, drove Strothers to the Omar store when she knew, or should have known, that Schultz had a protective order against him.
Kilgore told Schultz she had to leave the premises, not Strothers, and retaliated against her for reporting Strothers’ conduct t law enforcement authorities and for obtaining the protective order against him, according to the suit.
Schultz claims the defendant violated the West Virginia Human Rights Act.
Schultz is seeking compensatory and punitive damages. She is being represented by John Einreinhofer of the Law Offices of John Einreinhofer.
