Mother, son allege Mercer County school board caused injuries

PRINCETON — A Mercer County mother and son are suing the local school board and employees, alleging their negligence led to injuries to the son. 

K.M., by and through his guardian and next friend Tammy Martin, filed a lawsuit Dec. 12 in Mercer Circuit Court against Mercer County Board of Education and John/Jane Does 1-5, alleging they allowed an untrained employee to handle the boarding of students with special needs.

According to the complaint, on June 20, 2012, K.M. was being loaded into a school bus via the wheelchair lift when the lift malfunctioned, causing plaintiff K.M.'s wheelchair to fall forward. The suit says the fall caused K.M. personal injuries and damages. 

The suit says Tammy Martin suffered loss consortium of her son. The plaintiffs allege the defendants failed to provide proper training and supervision to their employees and failed to properly maintain their school buses.

The Martins seeks trial by jury, compensatory and punitive damages, pre- and post-judgment interest, attorney fees, court costs and expenses and all other relief. They are represented by attorneys Stephen P. New and Amanda J. Taylor of Beckley.
