MORGANTOWN — An estate representative is suing Charleston bar operators and a patron, alleging negligence that led to the fatality of a family member and unlawful sale of liquor to intoxicated persons.
Brent W. Sears, as personal representative of the estate of Carli Elizabeth Sears, deceased, filed a lawsuit Dec. 12 in Monongalia Circuit Court against Alexander Salvatore Hambrick, DC LLC, doing business as Jameson's Annex, Michael S. Shuman and Thomas H. Vanlandingham, alleging violation of the West Virginia Code.
According to the complaint, on Jan. 17, Carli Sears was walking on a sidewalk along Stewart Street in Charleston when she was struck by a motor vehicle being driven by Hambrick. As result of the violent collision, the suit says, Sears suffered catastrophic injuries that led to her death a few hours later.
The plaintiff alleges Hambrick was highly intoxicated and fled the scene of the accident without rendering aid. Prior to the incident, the suit says, Hambrick was a patron at Jameson's Annex, where he was served alcoholic beverages to the point of intoxication.
Brent sears seeks trial by jury, compensatory and punitive damages, interest and court costs. He is represented by attorney Thomas H. Peyton of Peyton Law Firm PLLC in Nitro.
