Family blames motorist, city of Weirton for crash injuries

NEW CUMBERLAND — A Weirton family is suing vehicle operators and the city of Weirton, alleging their negligence led to injuries for the plaintiffs in a car crash. 

Kevin Wheat, Jamie Wheat and Lindsey Wheat, an infant, filed a lawsuit Dec. 16 in Hancock Circuit Court against William E. Johnson, Joseph Bokros and the city of Weirton, alleging Bokros negligently entrusted the vehicle to Johnson and that Weirton did not properly maintain its roads.

According to the complaint, on Oct. 7, 2016, Johnson, operating a vehicle owned by Bokros, negligently crossed the center of the Marland Heights Road in Weirton. The suit says Johnson collided with another vehicle wherein the three plaintiffs were passengers. 

The lawsuit states the Wheats experienced pain and suffering, mental anguish, disfigurement, medical expenses of more than $10,000 and loss of consortium of each other. The plaintiffs allege Weirton failed to properly upkeep and maintain Marland Heights Road, which has been the scene of previous accidents, and that Johnson recklessly crossed the center dividing line of the roadway.

The Wheats seek trial by jury and compensatory damages against all defendants, jointly and severally, in excess of the jurisdictional limits of the court. They are represented by attorney Michael Edward Nogay of Sellitti, Nogay & McCune PLLC in Weirton.
