Wayne County Sheriff's Office corporal alleges unequal pay

WAYNE — A Cabell County man is suing officials associated with the Wayne County Sherriff's Office, alleging an unequal pay system.

Adam Baumgartner filed a lawsuit Nov. 7 in Wayne Circuit Court against Wayne County Sheriff Greg Farley, and Wayne County commissioners Robert E. Pasley, Kenneth R. Adkins and David H. Pennington, alleging violating the principle of equal pay for equal work inherent in civil service law.

According to the complaint, Baumgartner, a corporal in the Wayne County Sheriff's Office, has been performing the duties of a sergeant without receiving the difference in pay between a corporal and a sergeant. 

The plaintiff alleges the defendants denied him the rank of a sergeant as well as the additional compensation for the position.

Baumgartner seeks trial by jury, an order for his immediate promotion to the rank of a sergeant, full back pay for performing duties consistent with the rank of sergeant and that his pay be equal with other officers, attorney fees, costs and all other relief. He is represented by attorney Amy C. Crossan of Bouchillon, Crossan & Colburn LC in Huntington.
