House guest blames residence owner, bathtub manufacturer for injuries

WAYNE — A Wayne man is suing a homeowner and bathtub manufacturer, alleging their negligence led to injuries for the plaintiff. 

Okey J. Clayborne Jr. filed a lawsuit Nov. 9 in Wayne Circuit Court against Tara Clayborne and Bath Fitters, alleging Clayborne breached her duty to maintain her premises in a reasonably safe condition.

According to the complaint, on Dec. 30, 2014, Okey Clayborne was taking a shower at Tara Clayborne's residence in Wayne and was unaware that the bathtub had a crack. As he stepped into the shower with stagnant water, the suit said, he slid and was thrown off balance causing him to sustain severe injuries, including a staph infection that led to a toe being amputated. 

The plaintiff alleges Tara Clayborne failed to warn him of the dangerous condition and Bath Fitters defectively installed the bathtub.

Okey Clayborne seeks trial by jury, judgment against each defendant in excess of the jurisdictional limits of the court, plus costs and interest. He is represented by attorney Donald R. Jarrell of Wayne.
