Couple blames driver, motor carrier, insurer for crash

POINT PLEASANT — A Mason County husband and wife are suing a driver, motor carrier and insurer, alleging the defendants' negligence led to injuries for the wife. 

Amey S. Carr and David Carr filed a lawsuit Dec. 19 in Mason Circuit Court against Loren Charles Price, Farmers Friend Inc., doing business as Epling Trucking, and Nationwide Agribusiness Insurance Company, alleging Epling Trucking failed to maintain the motor vehicle in compliance with the law.

According to the complaint, on March 4, 2016, Price was driving a dump truck in the course of his employment with defendant Epling Trucking on W.Va. 2. The suit says Price negligently crashed the truck into the rear of a vehicle being driven Amey Carr.

The lawsuit says the crash caused Carr to sustain critical and permanent debilitating injuries. The suit says David Carr has lost the services and companionship of his wife.

The plaintiffs allege Price failed to maintain proper control of his motor vehicle, failed to keep proper lookout and failed to observe proper distance, and that Nationwide failed to provide under-insured motorist coverage.

The Carrs seek trial by jury, compensatory and punitive damages, contractual and extra-contractual damages, and all other appropriate relief. They are represented by attorneys Matthew L.
