Consumer blames food vendor, Speedway store for injuries

LOGAN — A customer is suing a food vendor and a Speedway convenience store, alleging negligence in failing to prevent injuries to the plaintiff.

Bradley Dugan of South Charleston filed a lawsuit Dec. 20 in Logan Circuit Court against Rolling Frito Lay Sales LP and Speedway LLC, alleging failure to provide a safe environment.

According to the complaint, on Dec. 23, 2014, Dugan was a customer at a Speedway store in Logan County. While attempting to step over a box that was blocking an aisle, the suit says, Dugan's foot caught the box, causing him to fall. The lawsuit states he suffered a fractured left wrist, which resulted in surgery, physical therapy and time missed at work. 

The plaintiff alleges Speedway failed to move the obstruction on the floor to provide a safe path to walk and failed to supervise or control the Frito Lay vendor's activity on its property.

Dugan seeks trial by jury, judgment in an amount that will fully and fairly compensate the plaintiff's injuries and damages, plus interest and costs of court. He is represented by attorney Donald C. Wandling of Wandling Law Office in Logan.
