Land owner alleges natural gas producer broke lease

WHEELING — A Pittsburgh-based land owner is suing two Charleston natural gas producers, alleging breach of lease agreement, conversion and unjust enrichment.

AMP Acquisition LLC filed a complaint Dec. 20, in Ohio Circuit Court against SWN Production Company LLC and CHK Utica LLC, a successor to Chesapeake Appalachia LLC, alleging failure and refusal to perform its contractual obligations regarding the use of land in Ohio County.

According to the complaint, as a result of defendants' improper actions sometime in 2014, AMP suffered monetary losses for not receiving royalty payments under the lease agreement with the defendants for more than 73 acres of property in Ohio County.

The plaintiff alleges despite continued production of oil and gas, the defendants have failed and refused to make any further lease payments and the required bonus payment.

AMP Acquisition seeks trial by jury, compensatory and punitive damages, pre- and post judgment interest and all other just and proper relief. It is represented by attorneys Arch W.
