Estate administrators blame sports bar operators for crash deaths

Car accident 23

HUNTINGTON — Two estate administrators are suing an estate and Cabell County bar operators, alleging unlawful sale of liquor to intoxicated persons caused the death of relatives in a vehicle crash.

Susan Julian, administrator of the estate of Samantha Marie Julian, and Marcelino Martin Ramirez, administrator of the estate of Joventino Martin Ramirez, filed complaints on Dec. 2 in Cabell Circuit Court against the estate of Kimberly Insco; RRR Corp., doing business as Stats Sports Bar; and KKM Inc., doing business as Route 60 Bar and Grill, alleging violation of the Dram Shop Act.

According to the complaint, on Dec. 5, 2014, Samantha Marie Julian and Joventino Martin Ramirez were passengers in a motor vehicle driving on Interstate Highway 64 in Barboursville. The suit says Insco, operating a motor vehicle while under the influence of intoxicating liquor, negligently collided with the vehicle, causing Julian and Ramirez's deaths as well as Insco's.

The plaintiffs allege Insco carelessly drove her vehicle on the wrong side of the road, and defendants Stats Sports Bar and Route 60 Bar and Grill negligently sold or served alcoholic beverages to Insco who was intoxicated.

Susan Julian and Marcelino Martin Ramirez seek trials by jury, compensatory, punitive and general damages in an amount to be set by jury, plus court costs, attorney fees and all other equitable relief both are represented by attorneys J. Michael Ranson and Cynthia Ranson of Ranson Law Offices in Charleston.
