CHARLESTON — A patient is suing Kanawha County health care providers, alleging malpractice because insufficient measures were taken to prevent injuries.

Rita Lyons filed a lawsuit Dec. 9 in Kanawha Circuit Court against Daniel Chianese, DPM and the Foot and Ankle Clinic of the Virginians Inc., alleging Chianese negligently deviated from acceptable standards of medical care.

According to the complaint, as a result of the defendants' negligence, Lyons has suffered pain and suffering, mental anguish, disfigurement, embarrassment and medical expenses. The plaintiff alleges Chianese negligently recommended unnecessary procedures to her right ankle and foot, failed to properly evaluate and treat the plaintiff's condition and failed to address alternative methods of treatment.

Lyons seeks trial by jury, judgment against the defendants, jointly and severally, for all damages she suffered, pre- and post-judgment interest, court costs and expenses and all other just and appropriate relief.
