Tractor-trailer driver accuses former employer of false reporting

CHARLESTON — A tractor-trailer driver is suing a Kanawha County freight business, alleging tortious interference and defamation.

Kevin Lusk filed a lawsuit Dec. 9 in Kanawha Circuit Court against Old Dominion Freight Line Inc. alleging falsely reported that Lusk had a Department of Transportation reportable accident.

According to the complaint, due to Old Dominion Freight's acts, Lusk was denied employment with the companies he applied for and was forced to accept a truck driving position with lower salaries and benefits. 

The plaintiff alleges the defendant falsely reported to HireRight that Lusk had a preventable Department of Transportation reportable accident.

Lusk seeks trial by jury, compensatory, consequential and punitive damages, plus interest, litigation costs and all otherequitable relief. He is represented by attorneys James D. McQueen Jr. of McQueen Davis PLLC in Huntington, and by Christopher J. Heavens of Heavens Law Firm PLLC in Charleston.
