Daughter blames health care providers for mother's injuries

Medical malpractice 05

CHARLESTON — A daughter is suing health care providers, alleging insufficient measures were taken to prevent injuries to her mother.

Lisa Smith, on behalf of her mother Dorothy Slover, filed a complaint Dec. 12 in Kanawha Circuit Court against Genesis Healthcare LLC, 1000 Lincoln Drive Operations LLC, et al, alleging failure to provide a safe environment free from abuse and neglect.

According to the complaint, between Jan. 5-Jan. 7, 2016, Slover was a resident at defendants' Valley Center in South Charleston, a skilled nursing facility, when she sustained personal injuries and physical damages. The suit says while under the defendants' care, Slover continued to suffer deterioration of health and physical condition, loss of dignity, disfigurement and emotional trauma.

The plaintiff alleges the defendants failed to properly manage and operate the nursing home, failed to take appropriate corrective actions when operational problems were brought to their attention and failed to ensure that residents needs were met.

Smith seeks trial by jury, compensatory and punitive damages to be determined by the jury, costs of court and all other relief. She is represented by attorneys James B. McHugh, Michael J. Fuller, Ka'Leya Q. Hardin and Kendra R. Fokakis of McHugh Fuller Law Group PLLC in Hattiesburg, Mississippi.
