CHARLESTON — A Kanawha County husband and wife are suing Wells Fargo Bank, alleging violation of real estate law.
Frederick A. Batton and Pamela Batton of Sissonville filed a complaint Dec. 12 in U.S. District Court for the Southern District of West Virginia against Wells Fargo Bank NA, alleging violation of the Real Estate Settlement Procedures Act.
According to the complaint, the Battons have suffered economic damages in the form of incorrect interest assessments and the inability to adequately monitor their home mortgage payments. The plaintiffs allege Wells Fargo Bank refused to honor the Battons' qualified written request for information about their loan and placed their partial payments to a suspense account and not applied to the loan balance.
The Battons seek trial by jury, judgment for $1,000 per violation and reasonable attorneys fees. They are represented by attorneys Benjamin M. Sheridan and Daniel K. Armstrong of Klein & Sheridan LC in Hurricane.
