Consumer alleges debt collector violated phone harassment law

WINFIELD — A Putnam County man is suing a debt collector, alleging violation of telephone harassment statutes.

Bryan Scott Godwin filed a complaint in Putnam Circuit Court against Alliance One Receivables Management Inc., alleging violation of the West Virginia Credit and Protection Act.

According to the complaint, when Godwin became in arrears upon an alleged debt, Alliance One began attempting to collect the alleged indebtedness. As a result of defendant's constant phone calls, the suit says, Godwin has been annoyed, abused harassed and oppressed. 

The plaintiff alleges Alliance One unlawfully engaged in unreasonable conduct in collecting a debt and continued to make collection calls even after Godwin requested the defendant to stop calling him and that he was receiving legal representation. 

Godwin seeks trial by jury, actual, punitive and statutory damages, costs of litigation and all other just and proper relief. He is represented by attorneys Daniel Armstrong, Daniel K. Armstrong and Michelle Lee Klein of Klein & Sheridan LC in Hurricane.
