Patient claims he was injured in fall at dialysis center

HUNTINGTON – A Huntington man alleges he slipped and fell because of hazardous condition at a dialysis center.

Michael Welch filed a complaint on Dec. 16 in Cabell Circuit Court against Fresenius Medical Care Holdings Inc., Cabell Huntington Hospital, Fresenius Kidney Care J. Robert Pritchard Dialysis Center, et al. alleging negligence.

According to the complaint, the plaintiff alleges that in Dec. 31, 2014, he was a patient at defendants' dialysis center when he slipped and fell on a liquid substance on the floor, causing him to sustain severe injuries that made him sick, sore, lame and disabled and suffer great pain and anguish.

The plaintiff holds Fresenius Medical Care Holdings Inc., Cabell Huntington Hospital, Fresenius Kidney Care J. Robert Pritchard Dialysis Center, et al. responsible because the defendants allegedly failed to provide sufficient notice or reasonable warnings of the existence of the dangerous condition.

The plaintiff requests a trial by jury and seeks judgment against defendants in an amount in excess of the basic jurisdictional limits of the court, together with interest and costs of this action. He is represented by Matthew R. Oliver of Vital & Vital LC in Huntington. The case has been assigned to Circuit Judge F. Jane Hustead.
