John Deere alleges recycling business owes more than $17,000

LOGAN — John Deere is suing a Verdunville recycling company, alleging breach of contract and a security agreement.

John Deere Construction & Forestry Co. filed a lawsuit Dec. 23 in Logan Circuit Court against Evans Recycling LLC and James H. Evans III, alleging failure to perform their contractual obligations.

According to the complaint, Evans Recycling purchased a new JD 60D compact excavator for $67,400, of which $40,144 was financed by John Deere. To date, the principal balance of $13,443.27 remains unpaid, the suit says. 

The plaintiffs alleges the defendants have defaulted on the contract by failing to make timely monthly payment since March 2016.

John Deere seeks trial by jury, the immediate and permanent possession of the excavator, money judgment of $13,443.27, attorney fees of $4,000, and all other proper relief. It is represented by attorneys W. Bradley Sorrells and Chelsea E. Richmond of Robinson & McElwee PLLC in Charleston.
