ATV owner blames repair shop operators for injuries

LOGAN — A Logan County ATV owner is suing local repair shop operators, alleging their negligence led to injuries for the plaintiff. 

Samuel Smith filed a complaint Dec. 27 in Logan Circuit Court against The Junction Motorsports LLC and Keith Gamble, alleging failure to perform repair work in a good and workmanlike manner.

According to the complaint, on Feb. 27, 2016, Smith entrusted his Yamaha ATV to defendants for repairs. On May 30, 2016, the suit says, Smith was operating his ATV when the rear wheels suddenly and unexpectedly locked up, causing him to lose control and be thrown from the vehicle. 

The lawsuit states Smith sustained multiple fractures, shattered hips, abrasions, skull fractures and other brain injuries. The plaintiff alleges the defendants negligently entrusted his vehicle to an inexperienced repairman and failed to supervise and oversee the repairs made on his vehicle.

Smith seeks trial by jury, judgment against each defendant in an amount sufficient to compensate him for injuries, plus punitive damages, interest, court costs and all other just relief. He is represented by attorneys Stuart Calwell and David H. Carriger of The Calwell Practice LC in Charleston.
