PRINCETON — A Kentucky railroad conductor is suing Norfolk Southern, alleging its negligence caused injuries to the plaintiff.
Wesley A. Salyers of Cumberland, Kentucky, filed a complaint Dec. 29 in Mercer Circuit Court against Norfolk Southern Railway Company, alleging negligence.
According to the complaint, on Jan. 4, 2014, while in the course and scope of his employment, Salyers and his crew were transported to a Days Inn Hotel in Princeton via a shuttle hired by Norfolk Southern. When he turned to enter the hotel, the suit says, Salyers slipped and fell on ice that caused him to sustain injuries to his back and right leg.
The lawsuit states his injuries were so severe, Salyers was unable to return to his job and may not be able to return in the future. The plaintiff alleges Norfolk Southern failed to provide a safe accommodation and failed to protect him from dangerous and unsafe condition.
Salyers seeks trial by jury, compensatory damages of $5 million, costs of court and all other appropriate relief. He is represented by attorneys Gregory B. Turpin and Thomas C. Bunting of The Moody Law Firm Inc. in Portsmouth, Virginia.
