Worker blames facility operator for injuries

PINEVILLE — A worker is suing a Charleston business, alleging the defendant's negligence led to injuries to the plaintiff.

Robert A. Scott of New Martinsville filed a complaint Dec. 30 in Wyoming Circuit Court against Axiall Corporation alleging failure to provide a safe environment for its business invitees.

According to the complaint, on June 12, 2015, Scott was working for Dandy Corp. at defendant's facility in Charleston. The suit says Scott fell due to a hazardous condition, causing him to sustain severe and disabling injuries that resulted in pain and suffering, mental anguish, inconvenience and medical expenses. 

The plaintiff alleges Axiall failed to warn its guests of the dangerous condition that existed on its property.

Scott seeks trial by jury, judgment for all damages in excess of the jurisdictional limits of the court and all other proper relief. He is represented by attorney M. Eric Frankovitch of Frankovitch, Anetakis, Colantonio & Simon in Weirton.
