Beckley employer business accuses insurance brokers of violating contract

BECKLEY — A Beckley professional employer is suing insurance brokers, alleging breach of implied covenant of good faith and fair dealing.

Employers' Innovative Network LLC filed lawsuit Jan. 3 in Raleigh Circuit Court against Black Wolf Consulting Inc., R. Maynor & Associates and Rod Maynor, alleging failure to perform contractual obligations.

According to the complaint, on Jan. 1, 2016, Employers' Innovative agreed to participate in the defendants' health insurance plan, which involved paying more than $900,000 per month. As a result of the defendants' actions, the suit says, the plaintiff's reputation was irreparably damaged. 

The plaintiff alleges the defendants did not transmit plaintiff's payment to Veritas or to the VEBA trust, failed to provide participants with insurance cards and failed to provide timely information when requested.

The plaintiff seeks trial by jury, compensatory and punitive damages, attorney fees, court costs and all other fair and just relief. It is represented by attorney Kevin L. Carr of Spilman Thomas & Battle PLLC in Charleston.
