CHARLESTON — A Kanawha County man is suing his former employers and a supervisor, alleging retaliation and wrongful termination.
Randall Watkins filed a lawsuit Jan. 4 in Kanawha Circuit Court against Act Fast Delivery of West Virginia Inc., Act Fast Delivery Inc. and Laura Hicks, alleging violation of the West Virginia Wage Payment and Collection Act.
According to the complaint, on Dec. 28, 2016, Watkins was terminated from his employment, leading to damages in lost wages and benefits, indignity, emotional distress and humiliation. The plaintiff alleges the defendants treated Watkins differently because they knew he worked at a different job until 5 p.m., terminated his employment in retaliation for his joining a lawsuit against the defendants due to wage payment violations and failed to pay all wages earned.
Watkins seeks trial by jury, all damages in an amount to be determined at trial, pre- and post-judgment interest, attorney fees and court costs and all other proper relief. He is represented by attorneys Carrie Goodwin Fenwick, James A. Kirby II and Lucas R. White of Goodwin & Goodwin LLP in Charleston.
