Therapist accuses mental health facility of discrimination

HUNTINGTON — A Kentucky therapist is suing a Cabell County mental health facility, alleging disability discrimination and wrongful or constructive eviction.

J.H. of Boyd County, Kentucky, filed a complaint Jan. 10 in Cabell Circuit Court against Prestera Center for Mental Health Services, alleging violation the West Virginia Human Rights Act.

According to the complaint, in January 2014, J.H. started suffering from severe allergy symptoms. Despite taking medications, the suit says, her symptoms continued and worsened. 

Due to Prestera Center's discriminatory acts, J.H. says she was forced to leave her employment. The plaintiff alleges the defendant discriminated against J.H. for her disability of a severe allergy to mold, made no efforts to remedy the situation and refused to accommodate her disability.

J.H. seeks trial by jury, compensatory, consequential and punitive damages, attorney fees, court costs and all other just and fair relief. She is represented by attorney James D. McQueen Jr. of McQueen Davis PLLC in Huntington.
