Property owner accuses grocery of breach of contract

WILLIAMSON — A Mingo County woman is suing a grocery, alleging breach of a lease/purchase agreement.

Lacy Muncy filed a complaint Jan. 10 in Mingo Circuit Court against Victory Lane Express Grocery LLC, alleging failure to fulfill its contractual obligations.

According to the complaint, on June 9, 2013, Muncy entered into a lease/purchase agreement with Victory Lane. Since August 2016, the suit says, Muncy has not received the defendant's monthly rent payment of $5,000. 

To date, the lawsuit states, the defendant is behind in payments in the amount of $25,000. The plaintiff alleges Victory Lane Express Grocery LLC intentionally avoided payment on the lease/purchase agreement.

Muncy seeks trial by jury, a civil injunction against the defendant, an order that the lease/purchase agreement be null and void and the property stay in the name of the plaintiff, punitive damages, attorney fees and all other necessary relief. She is represented by attorney Justin J. Marcum of Marcum Law Office PLLC in Williamson.
