Woman says Wayne Co. Commission didn't warn of ice on property

Waynecounty

WAYNE — A Logan County woman is suing the Wayne County Commission, citing that allegedly insufficient measures were taken to prevent injuries.

Judy Adkins filed a complaint on Jan. 6 in the Wayne Circuit Court against Wayne County Commission alleging that the commission breached its duty to maintain its premises in a reasonably safe condition.

According to the complaint, Adkins alleges that on March 6, 2015, she was at the commission's property. As she was getting out of her car, she stepped and fell on the ice. As a result, she sustained injuries to her left shoulder that required arthroplasty surgery and physical therapy. She holds the Wayne County Commission responsible because it allegedly failed to provide adequate warnings to its invitees about the unsafe condition on its premises.

Adkins requests a trial by jury and seeks judgment against the commission in an amount that will fully and fairly compensate her for her injuries. She is represented by Lia DiTrapano Fairless of DiTrapano Law Firm PC in Charleston.
